Cherry Hill slip and fall

Slip and Fall Injuries in Cherry Hill

Cherry Hill is one of South Jersey’s busiest shopping and dining destinations. The Cherry Hill Mall, the Garden State Park shopping district and the shopping centers lining Route 70 and Route 38 draw crowds every day, and the township is full of apartment and townhouse communities, office parks, hotels and medical buildings. More foot traffic means more spills, more worn flooring and more icy parking lots.

Falls can cause broken wrists, hips and ankles, knee and shoulder tears, back and neck injuries, and head injuries. If you were hurt because a property owner didn’t fix or warn about a hazard, you may have a premises liability claim.

Common causes

Common Causes of Falls We See

  • Spills, leaks and wet floors in supermarkets, big-box stores and restaurants
  • Snow and ice left on parking lots, sidewalks, walkways and entrances
  • Potholes, cracked pavement and uneven curbs in shopping-center lots
  • Broken, poorly lit or missing-handrail stairs in apartment complexes and offices
  • Loose mats, torn carpet and merchandise left in store aisles
  • Negligent security in parking lots and apartment complexes that leads to assaults

New Jersey law

What New Jersey Law Requires of Property Owners

Businesses owe customers a duty to keep their property reasonably safe. That means inspecting for hazards and then fixing them or warning people about them. To win, you generally need to show the owner knew, or should have known, about the hazard and didn’t act in time.

Self-service stores: In stores where customers handle products themselves, such as a supermarket produce aisle, New Jersey’s “mode-of-operation” rule can relieve you of proving the store knew about the specific spill. The New Jersey Supreme Court limits this rule to self-service settings (Nisivoccia v. Glass Gardens, 2003; Prioleau v. Kentucky Fried Chicken, 2015).

Snow and ice: Commercial property owners must keep their parking lots, walkways and the public sidewalk in front of their property reasonably clear (Stewart v. 104 Wallace Street, 1981). Under the ongoing-storm rule adopted in 2021, they generally don’t have to clear snow and ice while a storm is still underway, unless they made conditions more dangerous or a hazard existed before the storm (Pareja v. Princeton International Properties). Residential homeowners usually aren’t liable for snow on the public sidewalk in front of their home.

Apartments and rentals: Landlords and management companies must keep common areas like stairs, hallways, walkways and parking lots reasonably safe.

Your share of fault: Under New Jersey’s comparative negligence law, you can recover as long as you were 50% or less at fault, and your award is reduced by your share.

Public property: Falls on township, county or state property, such as a township sidewalk, a public building or a PATCO or NJ Transit station, fall under the New Jersey Tort Claims Act. A written notice of claim is usually due within 90 days, and the standards for liability are stricter.

After a fall

What to Do After a Fall in Cherry Hill

  1. Report the fall to the manager or property owner and ask for a copy of the incident report.
  2. Photograph the hazard, your shoes and the area before it’s cleaned up or salted.
  3. Get the names and phone numbers of witnesses.
  4. See a doctor promptly, such as at Jefferson Cherry Hill Hospital, and follow the treatment plan.
  5. Call a lawyer quickly. Surveillance video is often recorded over within days unless someone asks the owner to preserve it.

Questions

Cherry Hill Slip and Fall FAQs

Do I have a case if I slipped and fell at a Cherry Hill store?

Possibly. It depends on what caused the fall, whether the store knew or should have known about it, and how badly you were hurt. A free consultation can help you find out.

I fell on ice in a Cherry Hill parking lot. Can I sue?

It depends on when you fell and what the owner did. If the storm had ended and the lot still wasn’t cleared or salted within a reasonable time, the owner may be responsible. Write down the date and time of your fall and take photos.

I fell on a township sidewalk. Is the deadline different?

Yes. Claims against Cherry Hill Township, Camden County or another public entity usually require a written notice of claim within 90 days, so contact a lawyer right away.
